1. Acceptance of terms

By creating an account or using Kindwo (kindwo.com), you agree to be bound by these Terms of Service. If you do not agree, do not use the service. These terms apply to all users, including account holders and anyone who submits a testimonial through a Kindwo form.

2. Description of the service

Kindwo is a platform that allows users to collect professional testimonials via a public submission form, moderate them through a private dashboard, and embed approved testimonials on any website using a widget or REST API.

The service is provided on an "as is" basis. We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice where possible.

3. Account registration

To use Kindwo as an account holder you must provide accurate information including a valid email address. You are responsible for:

• Maintaining the confidentiality of your password and API keys
• All activity that occurs under your account
• Notifying us immediately if you suspect unauthorised access

You may only create one account per person. Accounts are non-transferable.

4. Acceptable use

You agree not to use Kindwo to:

• Submit or collect false, fabricated, or misleading testimonials
• Harass, impersonate, or harm any individual
• Distribute spam or unsolicited communications
• Attempt to gain unauthorised access to any part of the service
• Circumvent, disable, or interfere with security features
• Use the service for any unlawful purpose

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

5. User content and licence

You retain ownership of any content you create or collect through Kindwo, including testimonials submitted to your account.

By submitting a testimonial through a Kindwo form, the submitter grants Kindwo and the account owner a non-exclusive, royalty-free, worldwide licence to store, display, and embed that testimonial for the purpose of operating the service. This licence ends when the testimonial is deleted.

You are responsible for ensuring that any content collected through your account complies with applicable laws and does not infringe third-party rights.

6. Privacy

Your use of Kindwo is also governed by our Privacy Policy, which is incorporated into these terms by reference. By using the service you agree to the collection and use of data as described there.

7. Intellectual property

The Kindwo name, logo, and all software, design, and content produced by Kindwo are the property of Fares Hentati and are protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the service without prior written permission.

8. Disclaimer of warranties

Kindwo is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.

9. Limitation of liability

To the fullest extent permitted by law, Kindwo and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, revenue, or profits — arising from your use of or inability to use the service, even if advised of the possibility of such damages.

Our total liability to you for any claim arising from these terms or your use of the service shall not exceed the amount you paid us in the twelve months preceding the claim, or €10, whichever is greater.

10. Termination

You may delete your account at any time from your dashboard settings. Deletion is immediate and permanent — all your data will be removed.

We may suspend or terminate your account if you violate these terms, with or without notice depending on the severity of the violation. Upon termination, your right to use the service ceases immediately.

11. Changes to these terms

We may update these terms from time to time. We will notify registered users by email of material changes at least 14 days before they take effect. Continued use of the service after changes take effect constitutes your acceptance of the revised terms.

12. Governing law

These terms are governed by the laws of France, where the operator is based, without regard to conflict of law principles. Any disputes shall be resolved in the courts of France, unless local consumer protection laws in your country give you the right to bring a claim in your local courts.
